Um Norbert Hoersters Standpunkt zu verdeutlichen werde ich mit dem Essay „Wie schutzwürdig ist ein Embryo? Zu Abtreibung PID und Embryonenforschung“ und mit seinen Büchern „Ethik des Embryonenschutzes“ und „Neugeborene und das Recht auf Leben“ auseinandersetzen. Im Anschluss an die Vorstellung der beiden Positionen werde ich einen Vergleich vornehmen. Dieser Vergleich zielt darauf ab, gemeinsame Standpunkte herauszuarbeiten und zu erörtern worin sich die Ansichten der Philosophen unterscheiden. Im abschließenden Resümee folgt eine kurze Zusammenfassung und Beurteilung der vorgestellten Standpunkte zur Abtreibungsdebatte.

Dabei wird zu Beginn der Fall Daschner, der in Deutschland für eine breite Diskussion in Politik, Wissenschaft und der Öffentlichkeit gesorgt hat, als Aufhänger für diese Arbeit genutzt werden. Um das Leben eines entführten Kindes zu retten, hatte sich der Frankfurter Polizei-Vizepräsident dazu entschieden, dem Entführer mit Anwendung von Gewalt drohen zu lassen. Diese Folterandrohung, die Würde eines Menschen zu verletzten, um das Leben eines anderen Menschen zu retten, führte zu der Diskussion, ob es in bestimmten Notfällen nicht erlaubt sein sollte, von dem rechtsstaatlichen Handeln abzuweichen und durch die „Rettungsfolter“ Menschenleben zu retten.
Folter und Rettungsfolter bilden einen sehr weiten Themenbereich. In dieser Arbeit soll es vor allem darum gehen, die Diskussion der „Rettungsfolter“ in Deutschland zu untersuchen, ob sie mit den heutigen nationalen, wie internationalen Rechten in Einklang zu bringen wäre und ob sie auch moralisch vertretbar ist.
